Art. 1 - General provisions

    Browsing and placing a purchase order on the site implies acceptance of the Terms and Conditions and Data Protection Policies adopted by the site itself, as indicated therein.

These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by

  1. The user is required, before accessing the products supplied by the site, to read these General Sales Conditions which are generally and unequivocally accepted at the time of purchase.
  2. The user is invited to download and print a copy of the purchase form and of these General Conditions of Sale, the terms of which Nlighting Srls reserves the right to modify unilaterally and without notice.

Art. 2 - Object

  1. These General Conditions of Sale govern the offer, forwarding, and acceptance of purchase orders for products on https://www.lamposhop.com and do not, however, govern the provision of services or the sale of products by parties other than the seller who are present on the same site through links, banners, or other hypertext links.
  2. Before sending orders and purchasing products and services from different subjects, we suggest checking their terms of sale.

Art. 3 - Conclusion of the contract

  1. To conclude the purchase contract, it will be necessary to fill in the form in electronic format and send it following the relative instructions.
  2. It contains the reference to the General Conditions of Sale, the images of each product and the relative price, the means of payment that can be used, the methods of delivery of the products purchased and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and times for returning the purchased products.
  3. Before concluding the contract, you will be asked to confirm the reading of the General Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.
  4. The contract is concluded when the seller receives the form filled in by the user, after verifying the correctness of the data contained therein.
  5. The buyer will be obligated to pay the price once the online ordering process is completed. This will be done by clicking the "Buy Now" button at the end of the wizard.
  6. Once the contract is concluded, the seller takes charge of the order for its fulfillment.

Art. 4 - Registered users

  1. In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide his personal data correctly and truthfully.
  2. In any case, confirmation will release lamposhop.com from any liability regarding the data provided by the user. The user undertakes to promptly inform lamposhop.com of any changes to their data provided at any time. Should the user provide inaccurate or incomplete data, or should the interested parties dispute the payments made, lamposhop.com will have the right to refuse to activate or suspend the service until the relevant deficiencies are rectified.
  3. When a user first requests to activate a profile, lamposhop.com will assign them a username and password. The user acknowledges that these identifiers constitute the system for validating the user's access to the Services and are the only system capable of identifying the user. Any actions performed through such access will be attributed to the user and will be binding on them.
  4. The user undertakes to maintain the confidentiality of his/her access data and to safeguard them with due care and diligence and not to pass them on, even temporarily, to third parties.

Art. 5 - Availability of products

  1. Product availability refers to the actual availability at the time the buyer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before the order is confirmed.
  2. Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the buyer will be immediately informed by e-mail.

Art. 6 - Products offered

  1. lamposhop.com sells various products in different categories, starting from electronics, stage equipment, lighting, sometimes also relying on third-party sellers who express their willingness to promote their products on the lamposhop.com portal.

Art. 7 - Methods of payment and prices

  1. The price of the products will be the one indicated from time to time on the site, except where there is an obvious error.
  2. In the event of an error, lamposhop.com will notify the buyer as soon as possible, allowing the order to be confirmed at the correct price or cancelled. In any case, lamposhop.com will not be obligated to supply the item sold at the incorrectly indicated lower price.
  3. Prices on the site do not include VAT and shipping costs. Prices are subject to change at any time. Changes do not affect orders for which an order confirmation has already been sent.
  4. Once the desired products have been selected, they will be added to the cart. It will be sufficient to follow the instructions for the purchase, entering or verifying the information requested in each step of the process. Order details can be changed before payment.
  5. Payment can be made via:

Credit card, debit card, prepaid cards, PayPal account, bank transfer, third-party installment systems, cash on delivery.

(If you purchase with Scalapay, you'll receive your order immediately and pay in 3 or 4 installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related parties, and their assignees, and that you authorize such assignment.)

Art. 8 - Delivery

  1. lamposhop.com ships throughout Italy. Lamposhop.com will deliver to the user's home or any other address provided at the time of purchase.
  2. Delivery within Italy is generally within 1-2 business days and/or generally within 4 business days (excluding Saturdays and holidays), as determined by the customer when selecting the delivery method. Delivery times vary depending on the origin and destination of the shipment. If no delivery date is specified, delivery will be made within the estimated timeframe when selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation.
  3. For European Union countries, delivery will take 7-30 working days, and in any case, within a maximum of thirty days. 5. For non-EU countries, delivery will take approximately 7-30 working days. 6. If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify the location of the order and how to arrange a new delivery.
  4. If you are unable to be present at the place of delivery at the agreed time, we ask you to contact us again to agree on a new delivery date.
  5. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that the contract is terminated.
  6. Shipping costs are charged to the buyer and are explicitly highlighted at the time the order is placed.

Art. 9 - Passing of risk

  1. The risks relating to the products will pass to the buyer from the moment of delivery. The ownership of the products is considered acquired as soon as the complete payment of all amounts due in relation to the same, including shipping costs, is received, or at the time of delivery, if this occurs at a later time.

Art. 10 - Warranty and commercial compliance

  1. The seller is responsible for any defect in the products offered on the site, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian law.
  2. If the buyer has entered into the contract as a consumer, i.e., any natural person acting on the site for purposes outside of any business or professional activity, this warranty is valid provided that the defect becomes apparent within 24 hours of the date of delivery of the products; that the buyer submits a formal complaint regarding the defects within a maximum of 48 hours of receiving the package; and that the online return form is correctly completed. 3. In the event of non-conformity, the buyer who has entered into the contract as a consumer will have the right to replacement or termination of the contract for the disputed goods and the consequent refund of the price.
  3. All return costs for defective products will be borne by the seller.

Art. 11 - Withdrawal

  1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.
  2. In the case of multiple purchases made by the buyer with a single order and delivered separately, the term of 14 days starts from the date of receipt of the last product.
  3. The user who intends to exercise the right of withdrawal from the purchase can fill in and send an email to ppgad@pucrs.br
  4. The buyer must exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 not mandatory.
  5. All information regarding product packaging and the shipping address will be automatically sent via email after submitting the exchange/withdrawal form.
  6. The goods must be returned intact, in their original packaging, complete in all their parts, and with the accompanying tax documentation. Subject to the right to verify compliance with the above, the site will refund the amount of the returned products within a maximum of 14 days, net of any shipping costs.
  7. As required by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the reimbursement until receipt of the goods or until the purchaser demonstrates that he has returned the goods.
  8. The right of withdrawal does not apply if the services and products on lamposhop.com are included in the categories set out in Article 59 of Legislative Decree 206/2005. 9. The site will process the refund using the same payment method chosen by the buyer during the purchase process. In the case of payment by bank transfer, and if the buyer wishes to exercise their right of withdrawal, they must provide their bank details: IBAN, SWIFT, and BIC, which are necessary for the refund.

Art. 12 - Data processing

  1. By using the site, the user authorizes the processing of his personal data. This information is also valid for the purposes of Article 13 of EU Regulation no. 2016/679, concerning the protection of individuals with regard to the processing of personal data as well as the free circulation of such data.

The purpose of using this data is to process purchase orders and payments, communicate the data to third-party payment and shipping service providers, and provide informational contact information regarding the site's activities and services, and commercial offers from affiliated companies and commercial partners. 7. Providing data and consenting to its processing for the purposes of the contract, i.e., fulfilling the order and related payment, is necessary for the conclusion and execution of the contract. Therefore, refusal to provide such data or to consent to its processing will result in the user being unable to purchase the products and services offered.
  5. The provision of data and consent to processing for the purposes of commercial communications is optional. However, any refusal to provide such data or to give consent to its processing may result in the impossibility for the user to receive such additional services.
  6. The user always has the right to have his/her data updated, rectified or integrated, to have it deleted, transformed into anonymous form or to have the data processed blocked.

In the event of a violation of the law, including data whose retention is unnecessary for the purposes for which the data was collected or subsequently processed, certification that the operations have been brought to the attention, including with regard to their content, of those to whom the data was communicated or disseminated, except where such compliance proves impossible or involves the use of means manifestly disproportionate to the right being protected.

Art. 15 - Applicable law and competent court

  1. These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any other prevailing imperative rule of the buyer's country of habitual residence. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law.
  2. Any disputes inherent and / or consequent to the same must be resolved exclusively by the Italian judicial authority. In particular, if the buyer holds the status of Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law.
